Terms & Conditions

These Terms & Conditions govern your use of this website and any order placed with Diecast Model Centre Ltd. Please read them carefully before using the website or placing an order.

“We”, “us” and “our” refer to Diecast Model Centre Ltd, a company registered in England and Wales under Company No. 14431108, with its registered office at:

“You” and “your” refer to the person or organisation using this website or placing an order with us.

A “consumer” means an individual acting for purposes wholly or mainly outside that individual’s trade, business, craft or profession. A “business customer” means a person or organisation purchasing wholly or mainly for purposes connected with a trade, business, craft or profession.


1. Acceptance of These Terms

By accessing or using this website, creating an account or placing an order, you agree to be bound by these Terms & Conditions and the policies referred to within them.

If you do not agree to these Terms & Conditions, you should not use the website or place an order.

Nothing in these Terms & Conditions affects any statutory rights that cannot legally be excluded or restricted.


2. Use of This Website

You may use this website only for lawful purposes and in a manner that does not infringe the rights of others, disrupt the website or interfere with another person’s use of it.

You must not:

  • provide false, misleading or unauthorised information;
  • attempt to gain unauthorised access to the website, customer accounts or associated systems;
  • introduce malicious software or use automated systems in a way that places an unreasonable burden on the website;
  • use the website to commit or facilitate fraud;
  • attempt to misuse discounts, promotions, loyalty rewards, payment systems or returns procedures;
  • copy, scrape or reproduce website content for commercial purposes without permission.

We may restrict access, suspend an account or take other reasonable action where we believe the website, an account or our services are being misused.


3. Eligibility and Customer Information

You must be at least 18 years old to place an order independently. If you are under 18, an order may only be placed with the involvement and authority of a parent or guardian.

You are responsible for ensuring that the information supplied when placing an order is complete and accurate, including your name, billing information, delivery address, email address and telephone number.

You must have authority to use the payment method provided and, where ordering on behalf of a business or another person, authority to place the order on their behalf.

We are not responsible for delays, failed delivery or additional costs resulting from inaccurate or incomplete information supplied by you.


4. Customer Accounts

You are responsible for keeping your account credentials confidential and for activity carried out through your account.

Please contact us promptly if you believe your account has been accessed without authorisation.

We may suspend or close an account where reasonably necessary, including where we suspect fraud, misuse, unauthorised access, repeated payment disputes or attempts to circumvent these Terms & Conditions or our published policies.


5. Orders and Contract Formation

Placing an Order

When you submit an order, you are making an offer to purchase the goods shown in your order.

An automated order confirmation or acknowledgement confirms only that we have received your order. It does not mean that the order has been accepted and does not by itself create a binding contract.

Acceptance

A contract is formed only when we:

  • despatch the goods; or
  • otherwise expressly confirm in writing that the order has been accepted.

Different items within the same order may be accepted and despatched separately. In that case, a separate contract may be formed for each item or despatch.

Taking or authorising payment does not by itself constitute acceptance of an order.

Before Acceptance

Before a contract is formed, we may review, limit, refuse or cancel an order where reasonably necessary. Circumstances may include:

  • pricing, description, specification or listing errors;
  • stock shortages, allocation changes or supplier availability issues;
  • payment authorisation, identity or address verification issues;
  • suspected fraud, unauthorised payment or other suspicious activity;
  • suspected misuse of promotions, discounts, rewards or pricing arrangements;
  • unusually large quantities or unusual purchasing patterns;
  • suspected commercial purchasing or resale activity requiring clarification;
  • failure to provide information reasonably requested as part of an order review;
  • previous transactions that indicate an unacceptable payment, operational or commercial risk;
  • circumstances outside our reasonable control which prevent fulfilment.

If we decline an order before acceptance after payment has been taken, we will refund the amount paid to the original payment method.


6. Large, Unusual and High-Risk Orders

We may carry out an additional review before accepting an order that is large, unusual or likely to require a significant supplier commitment.

This may include orders involving:

  • multiple quantities of the same item;
  • an unusually high total value;
  • a large number of products;
  • products sourced specifically from one or more suppliers;
  • billing, payment or delivery details that require clarification;
  • a new customer account combined with an unusually large purchase;
  • purchasing patterns that appear inconsistent with ordinary personal collecting or gift buying;
  • indications that goods may be intended for commercial use, promotion, resale or onward supply.

As part of a review, we may request reasonable information about the customer, payment, intended use of the goods or authority to place the order. We may also limit quantities or decline the order before acceptance.

An order review does not mean that the order will be refused. It allows us to verify the transaction before committing stock or purchasing goods from suppliers.


7. Consumer and Business Purchases

When placing an order, you must ensure that the information you provide accurately reflects whether you are purchasing as a consumer or for purposes connected with a trade, business, craft or profession.

Where an order appears to have been placed wholly or mainly for business purposes, we may request reasonable information before deciding whether to accept it. This may include confirmation of:

  • the identity of the buyer;
  • whether the order is being placed personally or on behalf of an organisation;
  • the intended use of the goods;
  • whether the goods are intended for resale, promotion, business display, client use or another commercial purpose;
  • the buyer’s authority to place the order.

If the requested information is not provided, is incomplete or does not reasonably resolve the nature of the transaction, we may decline the order before acceptance.

A delivery to a workplace, use of a business address or payment from a business-related account will not by itself determine whether an order is a consumer or business purchase. We will consider the circumstances of the transaction as a whole.

Where a purchase is made wholly or mainly for purposes connected with a trade, business, craft or profession, it will be treated as a business purchase and consumer cancellation rights and other consumer-only protections will not apply.

Where the buyer legally qualifies as a consumer, statutory consumer rights will continue to apply and will not be removed by these Terms & Conditions.


8. Supplier-Sourced Products

Our website may show products that are available from our suppliers as well as products physically held by us. Supplier availability information may be updated regularly but cannot be guaranteed to remain unchanged between an order being placed and stock being secured.

Some products may be purchased or allocated specifically to fulfil a customer order. Before acceptance, we may decline or amend an order where:

  • the supplier no longer has the product available;
  • the supplier changes an allocation, price, specification or expected supply date;
  • the product cannot be obtained within a reasonable period;
  • the order presents an unreasonable commercial or operational risk before supplier stock is committed.

Nothing in this section removes cancellation, refund or other statutory rights that apply after a consumer contract has been formed.


9. Product Information

We take reasonable care to ensure product titles, descriptions, specifications, scale information, photographs and prices are accurate. However, information may be supplied by manufacturers or distributors and errors may occur.

Images are illustrative. Colours, packaging, decals, accessories, specifications and minor production details may differ from photographs or early manufacturer information. Device and screen settings may also affect colour appearance.

Scale dimensions are approximate and depend on the dimensions of the original vehicle or subject. Customers should check the stated scale and any approximate dimensions before ordering.

Unless expressly stated otherwise, products are sold as new collector models and are not toys. Age recommendations and safety information shown on product pages should be observed.

We may correct product information before accepting an order. If a material error is identified after acceptance, we will contact you and deal with the matter in accordance with applicable law.


10. Pricing

Prices are shown in pounds sterling and include VAT where applicable unless stated otherwise.

Delivery charges and any other mandatory charges will be shown before the order is submitted.

If an obvious pricing error is identified before acceptance, we may cancel the order or invite you to place a new order at the correct price. We will not knowingly accept an order at an incorrect price where the error should reasonably have been apparent.

Prices, promotions and availability may change without notice before an order is accepted.


11. Payment and Verification

Payment must be made using one of the methods offered at checkout or otherwise agreed by us.

We may carry out or request payment, identity, billing address or fraud-prevention checks before accepting an order.

We may decline or cancel an order before acceptance where:

  • payment is refused, reversed or cannot be verified;
  • the payment method appears unauthorised;
  • billing, account or delivery information is inconsistent;
  • additional verification is requested but not completed;
  • the transaction is assessed as presenting an unacceptable fraud or payment risk.

You must not initiate a chargeback or payment dispute dishonestly or as a substitute for contacting us about a genuine issue. This does not restrict your right to raise a legitimate dispute with your payment provider.


12. Delivery

Delivery services, charges, estimated timescales, geographical restrictions and other delivery information are set out in our Delivery Policy.

Delivery dates and times are estimates unless we expressly agree otherwise. We are not responsible for delay caused by inaccurate customer information, carrier disruption, customs procedures or events outside our reasonable control, although statutory rights remain unaffected.

Risk in consumer goods normally passes to the consumer when the goods are delivered into the physical possession of the consumer or a person identified by the consumer to receive them, subject to applicable law.


13. Pre-Orders

Pre-orders are subject to our separate Pre-Order Policy, which forms part of these Terms & Conditions where applicable.

Manufacturer release dates and supply estimates are not guaranteed and may change. Payment arrangements, deposits, cancellation rights, balance collection and despatch arrangements are explained in the Pre-Order Policy and on relevant product pages.


14. Returns, Cancellations and Faulty Goods

Consumer cancellation rights, our voluntary 30-Day Returns Guarantee, return costs, refund timescales and procedures for faulty or incorrectly supplied goods are set out in our 30-Day Returns Guarantee.

Nothing in our voluntary returns arrangements restricts statutory rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 or other applicable law.


15. Trade Pricing

Trade pricing may be offered at our discretion to approved business customers purchasing for resale or legitimate business use.

We may request evidence of business status and may approve, refuse, suspend or withdraw trade pricing at any time.

Unless otherwise agreed in writing:

  • a minimum product value of £50.00, excluding delivery charges, applies;
  • trade pricing cannot be combined with promotions, discount codes, vouchers, loyalty rewards, cashback, special offers or other pricing arrangements;
  • trade pricing is not available on pre-order items;
  • trade pricing is not available on gift cards or vouchers;
  • standard delivery charges and thresholds apply;
  • payment is required in accordance with the terms displayed or separately agreed;
  • the approved account must not be shared, transferred or used on behalf of an unauthorised third party;
  • purchases made using trade pricing are treated as business purchases.

We may amend, restrict, suspend or withdraw trade pricing where it is misused, where account information is inaccurate or where purchasing activity no longer meets our trade requirements.


16. Refusal of Future Orders

We reserve the right to refuse future orders, restrict account access, limit quantities or require additional verification where this is reasonable and proportionate to protect our business, customers, staff or suppliers.

This may apply where previous transactions or conduct have involved:

  • repeated cancellations after stock has been committed or specially sourced;
  • repeated returns that indicate misuse of our services or policies;
  • dishonest, misleading or inconsistent information;
  • repeated payment failures, reversals or disputed transactions;
  • promotion, discount, account or loyalty-scheme abuse;
  • fraudulent or suspected fraudulent activity;
  • abusive, threatening or harassing behaviour;
  • attempts to circumvent account restrictions or previous decisions;
  • conduct causing unreasonable commercial loss or operational disruption.

A decision to refuse future orders does not affect rights or obligations arising from a contract already accepted, and will not be made for an unlawful discriminatory reason.


17. Business Customers

The following provisions apply where the customer is purchasing wholly or mainly for business purposes.

  • Consumer cancellation rights do not apply.
  • Orders may not be cancelled after acceptance without our written agreement.
  • Returns other than for faulty, damaged or incorrectly supplied goods are at our discretion and may be subject to a restocking charge.
  • The business customer must inspect goods promptly and notify us of shortages, visible damage or incorrect supply within a reasonable period.
  • The business customer is responsible for ensuring that the goods are suitable for its intended business purpose.

Nothing in these Terms excludes any remedy or liability that cannot lawfully be excluded.


18. Intellectual Property

Website content, including text, photographs, graphics, logos, page layouts, product descriptions and branding, is owned by us or used under licence and is protected by intellectual property law.

You may view and use the website for personal, non-commercial shopping purposes. You must not copy, reproduce, republish, distribute, modify, scrape or commercially exploit website content without prior written permission.

Manufacturer names, product names and trademarks remain the property of their respective owners.


19. Liability

Consumers

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of statutory rights relating to goods;
  • any other liability that cannot legally be excluded or limited.

We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was formed or for business losses suffered by a consumer.

Business Customers

Subject to any liability that cannot lawfully be excluded, we will not be liable to a business customer for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of goodwill or business interruption.

Subject to any liability that cannot lawfully be excluded, our total aggregate liability to a business customer in connection with an order will not exceed the amount paid for the goods giving rise to the claim.


20. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, carrier disruption, industrial action, fire, flood, epidemic, pandemic, war, civil disturbance, government action, customs delay, supplier failure, transport interruption, telecommunications failure or widespread systems disruption.

Where such an event materially affects an accepted order, we will take reasonable steps to minimise disruption and will contact you where appropriate. Consumer rights to cancel or obtain a refund remain unaffected where applicable.


21. Third-Party Services and Links

The website may contain links to third-party websites or use third-party payment, delivery, review or other service providers.

We are not responsible for the independent content or practices of third-party websites. Use of a third-party service may also be subject to that provider’s terms and privacy information.


22. Related Policies

The following policies should be read alongside these Terms & Conditions and form part of the agreement where relevant:

If there is an inconsistency, any specific written terms applying to a particular product, service, promotion or trade arrangement will take priority for that matter, provided they are lawful and were made available before the contract was formed.


23. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, website, services or applicable law.

The version applying to an order is normally the version in force when the order is placed. Changes will not retrospectively remove rights under an existing contract.


24. Severability and Waiver

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

If we do not enforce a provision immediately, this does not mean that we have waived the right to enforce it later.


25. Governing Law and Jurisdiction

These Terms & Conditions and contracts between you and us are governed by the laws of England and Wales.

If you are a consumer, you may also benefit from mandatory protections in the country where you live and may be entitled to bring proceedings in your local courts where applicable law provides that right.

If you are a business customer, the courts of England and Wales will have exclusive jurisdiction, unless otherwise agreed in writing.
